Terms of Service
1. Scope of Services
The Contractor provides premium digital visualization services, including Digital Home Staging, Virtual Renovation, and Architecture Staging. These services are provided exclusively in digital form.
2. Contract Formation
A binding contract is only formed once both parties have signed a specific Service Agreement following an initial, non-binding consultation.
3. Client’s Duty of Cooperation & Image Rights
The Client is responsible for providing high-resolution source material and warrants that they possess all necessary copyrights. The Client shall indemnify the Contractor against any third-party claims arising from the use of these images.
4. Disclosure Obligation (Labeling of Digital Content)
Duty to Disclose: The Client is strictly prohibited from presenting the visualizations as the actual, current physical condition of the property.
Labeling: The Client is legally obligated to clearly label all visualizations provided by the Contractor as "digitally staged," "virtual visualization," or with a similar clear disclaimer when using them in public listings, social media, or print materials.
Liability for Misrepresentation: The Client bears sole responsibility for the public presentation and marketing of the property. If the Client fails to disclose the digital nature of the images, or represents them as "real," the Client assumes full liability for any resulting legal disputes, claims for damages, or accusations of misleading advertising.
Deviations: The Client must inform potential buyers that the visualizations are artistic impressions and that deviations between the digital image and the actual physical property are possible and expected.
5. Copyright and Usage Rights
The Contractor remains the sole owner of the intellectual property. Upon full payment, the Client receives a non-exclusive license to use the visualizations for marketing the specific property defined in the Service Agreement.
6. Disclaimer for Visualizations
Digital Home Staging and Virtual Renovations are intended for illustrative marketing purposes only. They do not constitute architectural plans or guarantees of structural feasibility. The Contractor assumes no liability for discrepancies between the digital visualization and the actual physical condition of the property.
7. Revisions and Acceptance
Each Service Agreement includes two (2) rounds of minor revisions. Once final files are used in public listings, the service is considered accepted.
8. Payment Terms
Payments are due as specified in the individual Service Agreement. Final files will be released upon full payment.
